INFORMATION ON THE PROCESSING OF PERSONAL DATA (EU Reg. 2016/679)

E. BERGAMASCHI & FIGLIO S.p.A. (the Company) acquires your personal data directly from you and, in some cases, such data may be collected from third parties.
For the purposes of this information: (i) the processing of personal data means any operation or set of operations, carried out with or without the aid of automated processes and applied to personal data or sets of personal data, such as collection, registration , organization, structuring, storage, adaptation or modification, extraction, consultation, use, communication by transmission, dissemination or any other form of making available, comparison or interconnection, limitation, cancellation or destruction; (ii) personal data means any information concerning you and through which it is possible, directly or indirectly, your identification, with particular reference to an identifier such as the name, an identification number, location data, an identifier online or one or more characteristic elements of your physical, physiological, genetic, psychic, economic, cultural or social identity.
All personal data is processed in compliance with current legislation, which provides, among other things, that the data be: (i) processed lawfully, correctly and transparently; (ii) collected for specific, explicit and legitimate purposes, and subsequently processed in a way that is not incompatible with those purposes; (iii) accurate and, if necessary, updated; (iv) adequate, relevant and limited to what is necessary in relation to the purposes of the processing; (v) kept in a form that allows the identification of the data subjects for a period of time not exceeding the achievement of the purposes for which they are processed and (vi) processed in a manner that guarantees adequate security, including protection, by means of measures adequate technical and organizational methods, from unauthorized or unlawful processing and from accidental loss, destruction or damage.
1) PURPOSE AND LEGAL BASIS OF THE PROCESSING
The personal data concerning your person that will be provided by you directly through this website are necessary for the execution of the contractual relationship between you and our company.
The legal basis of the processing will therefore be the need to execute the contractual relationship between you and our company.
2) METHOD OF TREATMENT
Your personal data will be processed:
- on magnetic and paper media, by persons authorized to carry out these tasks, constantly identified, properly trained and made aware of the constraints imposed by current legislation;
- with the use of security measures to ensure their confidentiality and to avoid undue access to third parties or unauthorized personnel.
3) PROVISION OF DATA AND REFUSAL OF CONSENT
The provision of data is not mandatory but in case of refusal, total or partial, to provide the data or to consent to their processing and / or their communication, it will not be possible to proceed with execution of operations of your direct interest relating to the existing contractual relationship with us.
4) COMMUNICATION, DIFFUSION AND TRANSFER OF DATA
Personal data may be disclosed or may in any case be disclosed for the same purposes indicated above or imposed by law, to subjects operating in the banking, insurance and financial sectors, subsidiaries or associates, consultants, accountants, data processing companies and in general to all subjects to whom the communication is necessary for the correct fulfillment of the purposes indicated in point 1. Personal data are not subject to disclosure or to any fully automated decision-making process, including the profiling. Personal data may be transferred to countries of the European Union and to third countries with respect to the European Union for the purposes referred to in point 1.
5) DATA RETENTION PERIOD Personal data will be kept for the entire duration of the contractual relationship with our company and for ten years following its termination.
6) RIGHTS OF THE INTERESTED PARTY The current legislation gives you the right:
- to obtain from the owner confirmation of the existence or otherwise of their personal data and their making available in an intelligible form, in a structured format of common use and readable by an automatic device to transmit them to another data controller;
- to have knowledge of the origin of the data, of the purposes and methods of the processing, of the logic applied to the processing, of the identity of the owner and of the subjects to whom the data may be communicated;
- to withdraw the consent to the processing, without prejudice to the lawfulness of the processing based on the consent acquired before the revocation;
- to obtain the updating, rectification and integration of data, cancellation, transformation into anonymous form or blocking of data processed in violation of the law; he also has the right to object, for legitimate reasons, to the processing of data
- to lodge a complaint with the Guarantor for the Protection of Personal Data.
7) HOLDER OF THE TREATMENT AND RESPONSIBLE FOR DATA PROTECTION
The data controller is E. BERGAMASCHI & FIGLIO S.p.A. with registered office in Bresso, via Romani n.13 / 21 in the person of the legal representative pro tempore. The data controller has not appointed a personal data protection officer (RPD, or DPO: Data Protection Officer).
8) DEFINITION OF PARTICULAR CATEGORIES OF PERSONAL DATA
We mean by:
- "personal data" any information concerning an identified or identifiable natural person ("interested party"); the natural person who can be identified, directly or indirectly, with particular reference to an identifier such as a name, an identification number, location data, an online identifier or one or more characteristic elements of his physical identity, is considered identifiable, physiological, genetic, psychic, economic, cultural or social;
- "special categories of personal data" personal data suitable for revealing racial or ethnic origin, religious or philosophical beliefs, or trade union membership, political opinions, as well as genetic data, biometric data intended to uniquely identify a natural person, data relating to the health or sexual life or sexual orientation of the person.
